1.2    If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use ("Terms of Use"), which govern your use of this website. In these Terms of Use, the terms "SCS", "we", "our" or "us" refer to the owner and operator of this website. The term "you" refers to the user or viewer of this website.

1.3    You are responsible for ensuring that all persons who access this website through your internet connection are aware of these Terms of Use and other applicable terms and conditions, and that they comply with them.

1.4    We recommend that you print a copy of these Terms of Use for future reference.

1.5    If you do not agree to these Terms of Use, you must not use this website.

2.1    Your use of this website is also subject to our privacy policy.  Our privacy policy explains what information we will collect from you when you use this website and how we will use this information.

In the case of a serious breach of these Terms of Use (as determined by us in our absolute discretion), we may temporarily or permanently withdraw your right to use this website, take legal action against you and/or disclose such content to law enforcement authorities. 

5.3.3    We also have the right to disclose your identity to any third party who is claiming that any content posted by you to our website constitutes a violation of their intellectual property rights, or their right to privacy.

We also reserve the right not to publish such content in whole or in part or to remove such content in whole or in part.

If you want to make additional use of any of our material outside the terms of this disclaimer, you should apply to the brand for the appropriate consent and conditions.

13.3    We may transfer, assign, sublicense or pledge in any manner whatsoever, any of our rights and obligations under these Terms of Use to any third party without notice and without the need to receive your consent. You may only transfer, assign, sublicense or pledge your rights or your obligations under these Terms of Use to another person if we provide our consent to you in writing.

14.    APPLICABLE LAW

14.1    Please note that these Terms of Use, the Donation Terms and their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

16.    DONATION TERMS AND CONDITIONS

16.1    These Donation Terms apply when you make a Single Donation or a Monthly Donation to us.

16.2    If you do not agree with these Donation Terms, do not make a donation to Shiverpool Community Spirit via our website.

16.3    You can make a single donation to SCS via our website (“Single Donation”). These Donation Terms apply separately to each Single Donation you make.

16.4    You can make successive donations to SCS via our website, where you have set up a monthly donation (“Monthly Donation”). These Donation Terms apply to all successive and future donations made as a Monthly Donation.

16.5    All donations through our website are to be made via our payment services provider Stripe.

16.5.1    Before we can process a donation through our payment services provider, we will ask you for the following information: Name, Email address, Payment information, SCS marketing preferences.

16.5.2    Any information given to us in order to process your donation is held in accordance with our Privacy Policy, which form part of these Donation Terms.

16.5.3    By making payment through our payment services provider, you authorise the charge(s) to be made to your card, both for any relevant Single Donation and/or relevant future payments if you are making a Monthly Donation, in accordance with these Donation Terms.

16.5.4    We are not responsible for your acknowledgement or acceptance of our payment services provider’s applicable terms and conditions, which are separate from our own.

16.5.5    An automated acknowledgement email via our payment services provider will be sent to the email address you provided while making your donation.

16.6    If you become aware of fraudulent use of your card, you must notify and contact your card provider.

16.7    Should you wish to manage, change or cancel your Single Donation or Monthly Donation, please contact us via email on shiverpoolcommunityspirit@gmail.com. You cannot revoke authorisation for payment of any given Single Donation or Monthly Donation but you can seek to change how your donations are managed moving forward.

16.8    As a registered CIC, we are subject to rules for England and Wales; company law under companies Act 2006, audit investigations Act 2004 along with the CIC company registration Act 2005. As a rule, CIC’s are not permitted to refund any donations. If you do have any concerns regarding your donation, please contact us using the details provided in paragraph 16.7.

16.9    We will try to use your donation within your stated charitable programme. However, donations are used at our discretion, but always within our stated charitable objectives.

16.10    We have complete discretion over whether to accept any donation made to SCS through our website and reserve the right to reject any donation made to us, for any reason.

16.11    Both Single Donations and Monthly Donations are gifts to SCS. We hold no liability in relation to any donation made to SCS, regardless of whether we accept or reject any donation, save to the extent that losses are attributable to the fault of SCS. We do not exclude or limit any liability which cannot be excluded or limited by reason of any law of England.

16.12    We may transfer, assign, sublicense or pledge in any manner whatsoever, any of our rights and obligations under these Donation Terms to any third party without notice and without the need to receive your consent. You may only transfer, assign, sublicense or pledge your rights or your obligations under these Donation Terms to another person if we provide our consent to you in writing.
